ACCIDENT WAIVER AND RELEASE OF LIABILITY

The individual named below (referred to as “I” or “me”) desires to participate in group rides, and associated activities as a rider or as a volunteer (the “Activity”) organized by the Queen City Bicycle Collective, a New Hampshire nonprofit corporation (the “Collective”). In consideration of being permitted by the Collective to participate in the Activity and the intangible value that I will gain by participating in the Activity, and in recognition of the Collective’s reliance hereon, I agree to all the terms and conditions set forth in this instrument (this “Release”). Participation in the Activity is conditioned upon compliance with all event rules, safety instructions, and directions provided by the Collective.

I am aware and understand that the Activity is a potentially dangerous activity and involves the risk of serious injury, disability, death, property damage, and other social and economic losses. I acknowledge that any injuries I sustain may result from or be compounded by my own actions or inactions, the actions or inactions of other participants, the condition of the roads, trails, or facilities on which the Activity occurs, or the actions, omissions, or negligence of the Collective or any Releasees, including any negligent emergency response or rescue operations. Notwithstanding these risks, I acknowledge that I am voluntarily participating in the Activity with knowledge of the dangers involved and hereby agree to accept and assume any and all risks of injury, disability, death, property damage, and other losses arising from my participation in the Activity, whether caused by the ordinary negligence of the Collective or otherwise, to the fullest extent permitted by law.

I affirm that I am qualified, in good health, and in proper physical condition to participate in the Activity. I am aware that the Collective recommends that I seek the advice of a physician before engaging in exercise such as road or mountain biking. I have not been advised by a physician that I should not engage in the Activity.

I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers and assigns.

Biking, whether on road or off-road, presents mental and physical challenges which can be extreme. I acknowledge that the Activity may occur on public roads and facilities that may be open to the public during the Activity and accept the risks that arise in connection with the use of public roads and facilities. I acknowledge that trails may include natural and artificial obstacles that present hazards, especially when trails are wet, steep, off-camber, composed of loose surfaces, or include routes that are close to or go over cliffs or other drop-offs. Some surfaces, including grass, roots, and some rock formations are particularly slippery when wet. If at any time I believe conditions to be unsafe, I will immediately discontinue participation in the Activity.

I agree to follow all instructions, directions, and safety guidance provided by the Collective, including but not limited to ride leaders, ride marshals, event staff, and volunteers. I understand that these instructions are intended to promote the safety of all participants and members of the public.

I acknowledge that the Collective reserves the right, in its sole discretion, to deny or terminate my participation in the Activity at any time if my conduct is deemed unsafe, disruptive, unlawful, or inconsistent with event guidelines or safety instructions. If asked to leave or discontinue participation, I agree to do so immediately and understand that failure to comply may result in removal from the Activity without refund or further participation.

I hereby expressly waive and release any and all claims, now known or hereafter known, against (i) the Collective and its officers, directors, managers, employees, agents, affiliates, volunteers, and members; (ii) other participants in the Activity; (iii) any sponsors, advertisers, or supporters of the Activity; (iv) any individual, company, or other organization which holds an interest in or over any property on which the Activity may be conducted; and (v) their respective successors and assigns (collectively, “Releasees”), on account of injury, disability, death, property damage, or other loss arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Collective or any Releasees or otherwise, to the fullest extent permitted by law. I covenant not to make or bring any such claim against the Collective or any other Releasee and forever release and discharge the Collective and all other Releasees from liability under such claims.

I shall defend, indemnify, and hold harmless the Collective and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including any attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by or awarded against the Collective or any other Releasees arising out of, or resulting from any claim of a third party related to my participation in the Activity.

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation or evacuation. I hereby release, forever discharge, and hold harmless the Collective from any claim based on such treatment or other medical services.

This Release constitutes the sole and entire agreement between the Collective and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Collective and me and any respective successors and assigns.

By signing, I acknowledge that I have read and understood all of the terms of this Release, that I agree to those terms, and that I am voluntarily giving up substantial legal rights, including the right to sue the Collective and the Releasees.

PARENT OR GUARDIAN WAIVER FOR MINORS (Under 18 years old)

The undersigned parent or legal guardian represents that he or she is the lawful parent or guardian of the minor rider(s) listed on this form, or is otherwise legally authorized to sign on their behalf, and has full authority to execute this Release on their behalf.

I understand the nature of bicycling activities and the inherent risks involved. I affirm that I am familiar with the minor rider’s experience and capabilities and believe the minor rider to be qualified, in good health, and in proper physical condition to participate in the Activity.

On behalf of the minor rider(s), I acknowledge and agree to all terms and conditions of the Accident Waiver and Release of Liability above, including the assumption of risk, release of claims, indemnification, medical consent, and participant conduct and compliance provisions. I understand that participation in the Activity is conditioned upon compliance with all event rules and safety instructions.

I hereby release, waive, and discharge the Collective and all Releasees, as defined above, from any and all claims or causes of action arising out of or related to the minor rider’s participation in the Activity, whether caused by negligence or otherwise, to the fullest extent permitted by law.

I further agree to defend, indemnify, and hold harmless the Collective and the Releasees from any and all claims, demands, losses, liabilities, damages, costs, or expenses, including attorney fees, arising out of or related to the minor rider’s participation in the Activity, including any claim brought by or on behalf of the minor rider.

I affirm that I have provided accurate emergency contact information for each minor rider and consent to emergency medical treatment as described above.

By signing for each minor rider below, I acknowledge that I am legally authorized to sign on behalf of that minor rider and that I agree to this Release both on their behalf and in my individual capacity.
